0. Definitions Guest:
- The booking party and all accompanying persons.
- Booking: Any reservation confirmed by the Landlord (email/portal/written form), creating a binding rental agreement.
- Rate: Selected price plan (e.g., Standard, Non-refundable, Corporate).
- Security Deposit: Monetary security covering damages, extra costs or unpaid charges.
- House Rules: Usage and conduct rules (Annex B).
1. Subject & Services
1.1 Furnished apartment provided for non-commercial temporary accommodation.
1.2 Included in the price (unless stated otherwise): utilities (electricity/water/heating), Wi-Fi, TV (public levies excluded), and a weekly full cleaning incl. linen change on request.
1.3 Add-ons (e.g., extra cleanings, parking, laundry/ironing, baby cot) can be booked and charged separately.
2. Booking, Payment, Price Components
2.1 A binding contract is formed upon booking confirmation. Minimum age:18. ID required at check-in.
2.2 Total price is due at the time of booking by credit card. If payment is refused/charged back, the Landlord may cancel and relet; the Guest is liable for resulting losses.
2.3 A security deposit may be required (see Sec. 4). A credit-card pre-authorisation may be taken.
2.4 Prices in CHF, incl. Swiss VAT (special accommodation rate if applicable). Municipal taxes (e.g., city tax) are already included in the total price.
2.5 Invoices are provided electronically. Set-off is permitted only with undisputed or finally adjudicated claims.
3. Check-in / Check-out & Access
3.1 Check-in from 15:00 (earlier only with written confirmation; fees may apply).
3.2 Access is contactless via a personal key-box code. Keep the code confidential.
3.3 Check-out by 11:00; all keys must be returned into the key box by that time.
3.4 Unauthorised late check-out is charged per Annex A; stays beyond 12:00 may incur at least one full daily rate.
3.5 Lost/unreturned keys are charged per Annex A (incl. cylinder/lock system changes where necessary).
4. Security Deposit
4.1 Amount and form as stated in the booking confirmation.
4.2 The Landlord may use the deposit to settle due claims (damages, replacements, special cleaning, contractual penalties, post-charges, fees).
4.3 Refund within 21 days after proper check-out, less any claims; an itemised statement is provided.
5. Use, House Rules, Occupancy
5.1 Accommodation use only; commercial use, parties and events are prohibited.
5.2 Max occupancy per offer: [X] persons. Over-occupancy entitles to termination and a contractual penalty (Annex A).
5.3 Smoking inside the apartment is prohibited. Breaches trigger cleaning fees and penalties (Annex A).
5.4 Pets are not allowed.
5.5 House Rules (Annex B) apply (quiet hours, waste separation, fire safety).
5.6 Visitors allowed 08:00–22:00; overnight stays of additional persons only with prior approval, charges may apply (Annex A).
5.7 Subletting / sharing codes/keys with third parties is forbidden.
6. Cleaning & Maintenance
6.1 Weekly full cleaning incl. linen change is included on request; usual window 09:00–17:00.
6.2 Extra/special cleaning, heavy dirt, odour neutralisation, improper waste disposal etc. are charged per Annex A.
6.3 The Landlord may access the apartment for cleaning, maintenance, fault remedy or inspection with prior notice (or without in an emergency).
7. Inventory, Damage & Duty to Notify
7.1 Defects/damages must be reported in writing within 3 business days after move-in; otherwise inventory is deemed accepted.
7.2 Damages caused by the Guest (companions/visitors included) must be fully compensated; missing items likewise.
7.3 The Landlord may apply a reasonable damage flat fee or charge the proven actual cost.
7.4 Guests must take reasonable care (close windows, switch off hob, frost protection, airing to prevent mould, etc.).
8. Cancellation, No-show, Shortening
8.1 Standard rate: All bookings made via our website cannot be cancelled free of charge.
8.2 Shortening/non-use: no refund of amounts already paid.
8.3 Refunds shall be made – if agreed – by bank transfer, less any non-refundable third-party fees.
9. Price Adjustments, Taxes, Fees
9.1 For longer stays (> 30 nights), fair price adjustments are permitted in case of significant cost changes (e.g., energy, taxes), with at least 14 days’ notice.
9.2 Statutory/municipal levies are included in the total price; legal changes may affect pricing but are not shown as a separate surcharge.
10. Internet Use
10.1 Wi-Fi is provided free without warranty for availability, speed or fitness for purpose.
10.2 Illegal use (copyright infringement, hacking, spam, etc.) is prohibited; the Guest is liable for resulting costs/claims.
10.3 Access may be restricted in case of misuse.
11. Liability
11.1 The Landlord is liable only for wilful misconduct and gross negligence (except for injury to life, body or health).
11.2 No liability for outages or disturbances (power, water, heating, Internet), construction/neighbourhood emissions or force majeure beyond control.
11.3 No liability for items brought by the Guest; appropriate insurance is recommended.
12. Force Majeure
12.1 Events beyond reasonable control (e.g., natural events, pandemics, governmental orders, strikes, major infrastructure outages) suspend obligations for the duration of their effects.
12.2 Already rendered services remain due; no liability for consequential losses. Rebooking/credit may be offered at the Landlord’s discretion.
13. Breach, Remedies & Termination
13.1 In case of material breach (incl. payment default, prohibited use, disturbance, over-occupancy, smoking), the Landlord may terminate without notice and demand immediate vacating; no refund.
13.2 Contractual penalties and flat fees per Annex A may apply; further damages remain reserved.
14. Data Protection
14.1 We process personal data to run the site and services (incl. access systems, possible CCTV in common areas), fulfil legal duties and communicate. See our Privacy Policy.
15. Final Provisions
15.1 Form: Amendments require written form (text form sufficient). Individual agreements prevail over these T&C.
15.2 Severability: Invalid terms do not affect the validity of the remainder; a valid, economically closest provision applies instead.
15.3 Governing Law / Venue: Swiss law. Venue—where permitted—is the registered seat of the Landlord / location of the property; mandatory consumer venues remain unaffected.
15.4 Contract language: German version prevails (English translation for convenience).
15.5 Electronic consent (online booking/check-in) equals a handwritten signature.
Annex A — Fees & Flat Rates
Early check-in (12:00–15:00): CHF 30/hour
Unauthorised late check-out:
– 11:01–12:00: CHF 50 flat
– 12:00–14:00: CHF 50/hour
– after 14:00: 1 daily rate
Lost key/badge: CHF 100 each
– Cylinder change (single lock): from CHF 250 (actual cost)
– Locking system/master key impacted: from CHF 800 (actual cost)
– Emergency opening: CHF 300 weekdays; CHF 450 evenings/weekends/holidays
– Administration fee: CHF 30
Smoking violation (non-smoking property):
– Contractual penalty: CHF 300
– Special cleaning/odour removal: from CHF 200 + CHF 60/hour
Extra/special cleaning:
– Extra cleaning on request: CHF 90 per visit (incl. linen change)
– Heavy dirt/“deep clean”: CHF 250 flat + CHF 60/hour
Unregistered overnight guest:
CHF 40/person/night
Improper waste disposal:
CHF 120 + municipal charges
Unwarranted technician/emergency call-out:
CHF 150 + third-party costs
Inventory replacement:
actual value + CHF 25 admin
Linen loss:
CHF 30 towel; CHF 80 bed-linen set
Dunning fees on late payment:
CHF 20 first reminder; CHF 40 further reminders + statutory default interest
